Decide and state clearly whether these terms also govern the supply and installation of goods and services, or whether that is handled by a separate written contract signed at the point of sale. Keeping the two separate is usually the cleaner approach.

Insert the quote validity period, what makes a quote conditional, the circumstances in which a quote can be varied after a site assessment, and how variations are agreed and documented.

Reproduce the mandatory consumer guarantee wording accurately and confirm whether the prescribed warranty-against-defects text is required. Ensure no clause anywhere in these terms purports to exclude, restrict or modify these guarantees, which would itself breach the ACL.

Set out the workmanship warranty term, what it covers and what voids it, and explain how it sits alongside manufacturer product warranties and the statutory consumer guarantees. Publish no warranty term until it is confirmed.

State who is responsible for eligibility, what happens if a scheme changes between quote and installation, and how certificate assignment is documented. Any statement that a rebate is guaranteed is a misleading-conduct risk under the ACL.

Insert the payment schedule, deposit terms and cancellation rights. Check whether the unsolicited consumer agreement provisions of the ACL apply, since they impose specific cooling-off periods and disclosure obligations where an agreement is negotiated at a consumer's home or by telephone.

Any limitation of liability must be drafted by a lawyer and must operate subject to the non-excludable rights under the Australian Consumer Law. A broad exclusion clause is both unenforceable and a compliance risk.

State the version number and the date these terms last changed, and how a change will be notified to customers with a quote or contract in progress. Replace this block with the version line itself once there is one.
